Board of Education Grants Superintendent Emergency Powers to Respond to COVID-19

The Cumberland County Board of Education held an emergency meeting this morning and authorized the use of emergency powers by the superintendent in response to COVID-19. The Cumberland County Board of Education, acting under the authority provided by N.C.G.S. 115C-47, N.C.G.S. 115C-276, and any other applicable statutes, authorized the following:

1.     That Superintendent, Dr. Marvin Connelly, Jr., may take any lawful action he deems necessary to promote the safety and well-being of Cumberland County Schools students and staff in relation to COVID-19 without regard to any conflicting local Board of Education policy. In case of such a conflict, the Board of Education shall deem its policy waived.
2.     The Board of Education specifically authorizes Superintendent Dr. Marvin Connelly, Jr. to enter into contracts in excess of $90,000.00, which the Superintendent deems necessary to promote the safety and well-being of Cumberland County Schools students and staff in relation to COVID-19.
3.     The Board of Education specifically authorizes Superintendent Dr. Marvin Connelly, Jr. to modify existing school calendars, change and set school hours and bell times, assign and reassign students, and utilize school system facilities in any way he deems necessary to promote the safety and well-being of Cumberland County Schools students and staff in relation to COVID-19.
4.     The Board of Education will indemnify, defend, and hold the Superintendent harmless with respect to any decision made in good faith pursuant to the expanded authority provided by this Resolution.
5.     This Resolution shall remain in effect throughout the duration of the Governor’s March 10, 2020, State of Emergency declaration as set forth in Executive Order No. 116, and any extensions or modifications thereof.
